Appeal from an order of the Supreme Court (O’Connor, J.), entered May 17, 2007 in Ulster County, which denied defendant’s motion for summary judgment dismissing the complaint.
In March 2005, plaintiff Robert Hildenbrand (hereinafter plaintiff) was involved in a motor vehicle accident when his car was struck by a vehicle driven by defendant. Thereafter, plaintiff began experiencing headaches, neck pain and left shoulder pain with numbness and tingling down his left arm.
