HARPER, Judge.
Appellant was indicted, charged with assault to murder; he was convicted of the offense of aggravated assault, and his punishment assessed at two years confinement in the county jail.
It appears that appellant was sick with a cold or bronchial affection and called in Dr. J.. W. Hale. Dr. Hale prescribed for him, and in a few days thereafter appellant wrote him a note, which the doctor deemed insulting, and he refused to prescribe further.
