The writer of this opinion is unable to concur in the conclusion of the majority of this court, either upon the facts as shown by the record, and the inferences to be drawn therefrom, oí-as to the law applicable in this case.

The writer will first state a brief outline of the facts in the ease. Henry Heinholtz, plaintiff in error, was a joint owner with two other parties in a 23-acre tract of timbered bottom land, located some distance from the city of Henryetta, this state.
