Action in the district court for Hennepin county to set aside a sale and transfer of certain shares of stock by plaintiff to defendant, on' the ground of fraud and duress. The case was "tried before Simpson, J., who found in favor of defendant. From a judgment entered pursuant to the findings, plaintiff appealed.

The appellant and plaintiff, Edwin C. Shevlin, brought this action against his brother, the defendant and respondent, Thomas H. Shevlin, to declare void and to cancel a certain transfer of stock made by the plaintiff to the defendant and the contract executed in connection with it.

In Albany, New York, defendant was born on January 3, 1852; plaintiff, on June 8, 1867. When the younger brother was two or three years of age he received a severe injury to his skull, which to an undetermined extent influenced his subsequent development and history.
