WARREN, J.-

On the 24th day of September, 1931, a hearing was had on a claim filed 'by plaintiff and respondent at Sioux Falls, S. D., before Hon. D. R. P'erkins, industrial commissioner, without a board of arbitration. It appears that the board of arbitration was waived by reason of the fact that none of the parties submitted to the commissioner the names of the proposed members of said board. A full hearing was had before the industrial com missioner, and on the 3d day of October, 1931, compensation was awarded to the claimant, Wilmer C. Murray. Notice of the award was given to both parties.…
