July 24, 1905, appellant, James L. Thomas, and appellee, A. "F. Brya, entered into a written contract providing for the conveyance by appellant to appellee of the northeast quarter and the east 62 acres of the northwest quarter of section 18, township 3 north, range 6 west of the fourth principal meridian in Hancock county, Illinois, on March 1, 1906, for a consideration of $22,422.
