It appears, from the findings of the Court, that the property in controversy was sold for the non-payment of alleged State and county taxes of the year 1854. The county taxes were assessed by the Court of Sessions of Nevada county. There existed at the time no board of supervisors in that county, and it is contended by the appellant that the assessment by the Court of Sessions, and consequent levy and sale by the sheriff, were without authority and void.
