We will herein refer to the parties las they appeared in the trial court, where plaintiff in error was defendant and defendant in error was plaintiff.

This action was brought by plaintiff Reymunda Chavez against defendant W. K. Dawkins to obtain ia judgment for damages sustained by her as a result of the death of her nine-year-old daughter allegedly caused by defendant while driving his automobile recklessly, negligently and carelessly in the city of Denver.
