LATTIMORE, Judge.

In this case appellant was convicted of murder in the District Court of Gregg County, and his punishment fixed at confinement in the penitentiary for a term of ninety-nine years.

It appears from the record that appellant, Joe Henderson, and his son, Charles Henderson, were in an automobile, going to the town of Longview, and that they overtook a wagon, in which the deceased, Robert Killingsworth was, he being accompanied by a negro named Henry Sargent, who was driving the wagon.
