Plaintiff in error, herein referred to as defendant, was charged in an information with unlawfully having in his possession and under his control a narcotic drug, can nabis, commonly known as marijuana. Defendant was adjudged guilty and sentenced. He brings the case here by writ of error. On the trial defendant offered no evidence.
None of the points here urged for reversal were presented to the trial court in the motion for new trial filed by defendant’s counsel. The record here does not contain all the instructions given the jury. The instructions challenged in this court were not objected…
