In a negligence action to recover damages for personal injuries, plaintiff appeals from an order of the Supreme Court, Nassau County, dated October 28, 1976, which denied her motion (1) to dismiss the affirmative defense of lack of jurisdiction predicated upon her failure to serve a notice of claim in accordance with the provisions of section 50-e of the General Municipal Law or (2) for leave to serve a late notice of claim.
