MEMORANDUM OPINION

This matter comes before the court on the plaintiffs motion to remand filed March 5, 2003. This matter was referred to the presiding United States Magistrate Judge for proposed findings of fact, conclusions of law, and a recommended disposition. See 28 U.S.C. § 636(b)(1)(B) (West 2000 & Supp.2002). In his May 1, 2003 Report and Recommendation, the magistrate judge recommended that this court grant the plaintiffs motion and remand this case to the state court.
