RONEY, Chief Judge:

Petitioner William Middleton was convicted of first-degree murder, grand theft and unlawful use of a firearm in the commission of a felony. The trial court sentenced Middleton to death for the crime of first-degree murder. The judgment and sentence were affirmed by the Florida Supreme Court, Middleton v. State, 426 So.2d 548 (Fla.1983), and the United States Supreme Court denied certiorari. Middleton v. Florida, 463 U.S. 1230, 103 S.Ct. 3573, 77 L.Ed.2d 1413 (1983).
