This controversy arose out of a life insurance policy. Oscar Broom Madson died on January 10, 1929. At the time of his death he carried a life insurance policy in the sum of $5,000' with the defendant Continental Life Insurance Company. The estate of the insured was named as the beneficiary in the policy. Prior to his death Mr. Madson assigned the policy to the plaintiff herein. By virtue of such assignment plaintiff claimed to be entitled to the proceeds of the insurance policy.
