The' Department of Revenue (“the Director”) issued a ten-year license denial to Justin Thomas Bowers (“Bowers”) pursuant to section 302.060(9). 1 On February 23, 2005, Bowers filed an “Appeal of Denial of Driving Privileges” in the Circuit Court of Newton County. In his petition, Bowers alleged that the Director had failed to prove all the elements of section 302.060(9).
