The bill in this caso was filed for the specific performance of a parol contract for the purchase of lands. The contract is alleged to have been made in 1844, between Daniel 0. Dodge, tlie fattier of defendant, and Josiab Austin, *464Both these parties were deceased before this suit was instituted. It is averred in the bill that Austin took posses-, sion under the contract immediately after it was made, and continued in the actual, open and notorious possession until about the tenth day of April, 1865, making in the meantime valuable improvements on the land.
