Rich Walker, the petitioner, avers that on the 14th day of December, 1922, by a judgment of the district court of Oklahoma county, predicated upon a verdict of a jury, he was adjudged guilty of a violation of the narcotic drug laws, with his punishment fixed at confinement in the penitentiary for a term of four years and to pay a fine of $5,000, the judgment further providing that:
“In default of payment of said fine the same shall be enforced by imprisonment until the fine shall be satisfied, at the rate of one dollar per dáy.”
