This was an action brought by the plaintiff against the defendant to recover on a policy of indemnity or liability insurance issued by the defendant, insuring the plaintiff as a taxicab company *793against liability from tbe operation of its taxicabs. Tbe policy was in fnll force and effect and tbe premium was paid wben tbe accident occurred.
