Appeal by plaintiffs from an order of the district court for Ramsey county, Brill, J., presiding, refusing a new trial after a trial by the-court.- The valuation made by the appraisers was $30,000. The court found the property to have been worth $50,000 at the date of the valuation.

The plaintiffs leased, September 28,1881, to the defendant, certain land in the city of St. Paul for the term of 40 years from that date, at the yearly rent of $1,000 for the first five years; for the second and for each succeeding period of five years (if the parties should not be able to agree on the yearly rent) the yearly rent, it was agreed, should be fixed by two referees, — one to be chosen by each of the parties, — and, if the two referees could not agree, they were to choose a third, and the award of any two of the three referees was to be binding and conclusive between the parties.…
