United States v. Finley
Court of Appeals for the Fifth Circuit
1Opinion of the Court
KING, Circuit Judge:
Defendant-appellant Jacob Pierce Finley appeals his conviction on one count of aiding and abetting possession with intent to distribute a controlled substance (methamphetamine) in violation of 21 U.S.C. § 841(a)(1) and 18 U.S.C. § 2. He argues, inter alia, that the district court erred by not instructing the jury as to simple possession of methamphetamine and by denying his motion to suppress text messages and call records recovered in a warrant-less, post-arrest search of his cell phone. For the reasons that follow, we AFFIRM.
