Appellants, mother and daughter, brought a civil action for assault and battery against a school janitor and for negligence against the principal, a teacher and a guidance counsellor at the daughter’s school, as well as against the District of Columbia as their employer, for damages allegedly caused by the janitor’s sexual assaults. After an initial trial, appellees’ motion for a new trial was granted on the grounds that the verdict against them was excessive, unconscionable and against the weight of the evidence.
