This action was commenced in the district court of Gage county by the plaintiff in error to recover damages of the defendant on account of injuries to his person and property- alleged to have been sustained by the falling of a bridge on a public highway in the defendant county, which plaintiff was crossing at the time. The petition was sufficient in form a,nd substance to state a cause of action, had it not shown upon its face that the suit was not commenced for more than thirty days after the injuries were sustained.
