The plaintiffs were the owners of certain land in Suffolk county, N. Y., which the State through the Long Island State Park Commission appropriated for State parks. On March 17, 1926, the plaintiffs brought an action in the Supreme Court of Suffolk county challenging the validity of the appropriation. This action came to trial in May, 1927, and the plaintiffs’ complaint was dismissed. An appeal has been taken from the judgment of dismissal and is now pending in the Appellate Division, Second Department.
