LEMMON, Judge.

This is an appeal from a jury verdict in a suit involving an injury to a 2\/2 year old child, James Gregory Lefevre, who was run over by an automobile belonging to the next door neighbor, Hugh Russell Bur-ney.

Mrs. Burney had returned to her home from an early morning shopping trip with her four year old daughter, Cynthia. They had bought a cake and other confectionary items for Cynthia’s birthday party that afternoon.
