PROCEDURAL HISTORY/ISSUES

This is an action to recover amounts purportedly due and owing to Henry and Mary Lewton (the Lewtons) for the care and pasturage of cattle belonging to Charles McCauley (McCauley). Procedural history involves the Federal Bankruptcy Court, Federal District Court and the Eighth Circuit Court of Appeals which is set forth below. The civil action in circuit court was commenced by service of Summons and Complaint upon McCauley on December 16, 1987.
