Petitioner, Juan Santa Garcia, was arrested and charged with a murder and rape that occurred in the City of Philadelphia on June 27, 1973. Subsequent to being held over for the action of the grand jury, but prior to indictment, counsel filed a petition to quash the array of the grand jury.1 A hearing on the motion was held before the *10undersigned on September 24, 1973.
