Introduction

This matter came before the Court upon (1) the debtor-in-possession’s (the “Hospital”) complaint seeking a temporary and permanent injunction against the Department of Health and Human Services (the “Department”) prohibiting the withholding of Medicare Program payments from the Hospital and from terminating the Hospital’s provider status under the Medicare Program and (2) the Hospital’s motion to issue a show cause order and determine that the Department is in violation of the automatic stay imposed by 11 U.S.C.…
