Appeal from a judgment of the Supreme Court (Dawson, J.), entered July 24, 1998 in Clinton County, which, inter alia, granted plaintiffs’ motion for partial summary judgment.
This appeal centers on a dispute between plaintiffs and de*682fendant over the ownership of a parcel of real property in the Town of Ausable, Clinton County.* The subject property, consisting of the easterly strip of the abandoned road bed of old Clintonville Road (hereinafter the old road), lies between plaintiffs’ property and defendant’s property.
