MORRISON, Judge.

The offense is driving while intoxicated; the punishment, a fine of $400.00.

Bill of Exception No. 1 complains of the court’s failure to sustain appellant’s plea in bar based upon former jeopardy. From the bill, it appears that at the prior term of the court the accused had been tried on the same charge and that during the course of such trial the jury began their deliberations at 2:15 p.m. and were discharged at 4:00 p.m. because of their inability to agree upon a verdict.
