MEMORANDUM OF DECISION
McGLYNN, District Judge.
This is a diversity case brought by Doris E. Altamuro, administratrix of the estate of her husband, Joseph S. Altamuro, against the defendant, Milner Hotel, Inc. (“Hotel”), for damages for the death of her husband resulting from the inhalation of fumes and carbon monoxide while attempting to rescue residents of the Hotel during a three-alarm fire that occurred there on October 11, 1978.
