Robert Hurst brought a state-wide class action lawsuit against Nissan North America, Inc. (“Nissan”) in Missouri state court on December 14, 2009, alleging that certain cars manufactured by Nissan had defective dashboards. The petition sought compensatory damages as well as attorneys’ fees and costs. On February 16, 2010, Nissan removed the action to federal court under the Class Action Fairness Act of 2005 (“CAFA”), 28 U.S.C. § 1832(d), § 1453.
