Affirming.

At the regular election held in Graves county in November, 1937, for choosing county officers for the term beginning the first Monday in January, 1938, and extending to the first Monday in January, 1942, W. H. Wyman was elected county attorney. ■ He qualified and discharged the duties of the office until his death on August-9, 1940. On August 12, 1940, Aubrey Hester was appointed to fill the vacancy.
