JOHNSON, Circuit Judge:

Pursuant to the Longshore and Harbor Workers’ Compensation Act, 33 U.S.C. § 901 et seq. (LHWCA), an administrative law judge (ALJ) found that Emile Smith became permanently and totally disabled because of a back injury he sustained while in the course and scope of his employment with Roger’s Terminal and Shipping Corporation. The Benefits Review Board affirmed the award, and Roger’s Terminal petitions this Court for review asserting that the administrative law judge failed to properly apply the burden proof in this ease.
