SIMPSON, Justice.
The appeal presents two questions:(1) May the proceeds of a bond issue voted to erect a new building for the county courthouse and jail be used for the erection of the structure elsewhere in the county seat than on the present courthouse site, where, in the call and on the election ballot was the recital that the plant was to be erected on the courthouse site?(2) Does the governing body of the county (board of revenue) have authority, under the circumstances, to contract validly for the sale of the present courthouse site?
It is our conclusion that an affirmative answer is due…
