MEMORANDUM AND ORDER
TROUTMAN, Senior District Judge.
The plaintiff instituted this action on December 18, 1984, pursuant to the Employee Retirement Income Security Act (“ERISA”), as amended by the Multiem-ployer Pension Plan Amendments Act of 1980 (“MPPAA”) (hereinafter simply “ERISA”), Pub.L. 93-406, 88 Stat. 832 (codified as amended in scattered sections of 26 and 29 U.S.C.), seeking to recover monies allegedly due it as a result of the defendants withdrawal from the Fund.
