delivered the opinion of the court.

In an action of. assumpsit appellee recovered a judgment against appellant for sum of $1,500 on a policy of insurance.

The first part of the declaration is as follows: “The plaintiff complains of defendant of a plea of trespass on the case on promises,'and alleges: ■■

“That the defendant on or about the 13th day of November, 1926, made its policy of insurance and delivered the same to the plaintiff, and for the consideration therein expressed promised..the plaintiff, in the terms of said policy and .the conditions -thereto…
