The respondent, as executor of the last will and testament of Ella Wilson, deceased, commenced a discovery proceeding in the Surrogate’s Court of Westchester county under section 205 of the Surrogate’s Court Act (Laws of 1920, chap. 928, as amd.) In his petition he prayed that the appellant, Milton P. Kaler, attend before the surrogate and be examined respecting certain bank accounts owned and standing in the name of the testatrix.
