JERTBERG, Circuit Judge.

Appellant was convicted by a jury on three counts of violating Title 21 U.S.C. A. § 174. 1 Count three of the indictment alleged the sale and facilitation of sale on or about July 16, 1959 by appellant and co-defendant Skinner of a stated quantity of heroin. Count four of the indictment alleged that on or about July 16, 1959, the appellant and co-defendant Skinner concealed, transported and facilitated the concealment and transportation of the heroin described in count three of the indictment.
