This is a suit in the probate court of Linn county by William Smith against the estate of Rebecca Smith, deceased, where it was tried and judgment rendered in favor of the plaintiff from which the defendant appealed. A change of venue was taken to Macon county, and tried', .from the judgment there rendered both parties appealed.
