McALLISTER, Senior Circuit Judge.

This is an appeal from the denial of a motion for an evidentiary hearing on a petition for a writ of habeas corpus, and from an order denying the petition for a writ of habeas corpus.

The background of the case is as follows: Appellant operated a retail jewelry business in rented premises on the first floor of a two-story building in Owensboro, Kentucky. He was in debt. His business was not thriving. On January 18, 1964, appellant left his store about 5:00 P.M. A half hour later the premises were discovered to be on fire and part of the building was burned…
