Plaintiff sued in a mechanics’ lien proceeding. By its statement of claim it sought to recover $969.00 from the general contractor and impose a mechanics’ lien on the property of Mr. and Mrs. Michael M. Monte Bell.

Brentwood Construction Company, the general contractor, went bankrupt and only Mr. and Mrs. Monte Bell defended. They filed an answer and excepted to the statement of claim. They asserted in their First Affirmative Defense that the statement of claim did not state a claim against them; likewise they asserted in their Sixth Affirmative Defense that the statement of claim…
