MEMORANDUM AND ORDER

Plaintiff began this action in the Court of Common Pleas for Monroe County, Pennsylvania on September 11, 1984 by filing a praecipe for a writ of summons. After a formal complaint was filed October 22, 1984, Defendant Roadway Express, Inc. [Roadway] filed a petition for removal 1 in this court pursuant to 28 U.S.C. § 1446, dated November 6, 1984.
