The 'action was one to recover on a promissory note; the defense, no consideration; trial to a jury; verdict for plaintiff for $650. Motions by the defendant were to set aside the findings of fact and for judgment, for judgment on answers to special questions, and for a new trial. The court overruled the motion to set aside the findings, permitted the withdrawal of the motion for new trial, and sustained the motion to set aside the general verdict and to render judgment for the defendant on the special findings. The plaintiff appeals.
