Appellees filed their petition against appellant and others in the Cook Circuit Court to establish their title to real estate under the Burnt "Records act. They alleged in their petition that they are owners of the property; that the character of their estate was a fee simple; that the public records of Cook county, so far as they relate to the title to said lands, were totally destroyed by fire October 9, 1871, and that the original title deeds, conveyances and instruments of writing relating to the title to said lands had been lost or destroyed, and are not in their power to produce in this…
