OPINION
JOSEPH S. LORD, III, Chief Judge.
This action challenges the practice of a number of savings institutions of charging their mortgagors interest from the date of settlement to the date of the first monthly payment. Plaintiffs allege in their third amended complaint that this practice violates the Truth in Lending Act (hereafter *144“TILA”), 15 U.S.C. § 1601 et seq. because the disclosure statement provided was inaccurate with respect to this charge. Plaintiffs also claim that the defendants conspired to make this unlawful charge in violation of the Sherman Act, 15 U.S.C.A. § 1.
