Defendant was charged by indictment with the offenses of two counts of homicide by vehicle in the first degree (Counts 1 and 2), two counts of violation of the Georgia Controlled Substances Act' (Counts 3 and 4), driving under the influence (Count 5), and driving on the wrong side of the road (Count 6). A jury returned a verdict of not guilty on the charge of driving under the influence. On Counts 1 and 2, defendant was convicted of the lesser offenses of homicide by vehicle in the second degree.
