STORY, Circuit Justice.

There is no controversy as to the facts in this case; and the whole resolves itself into mere questions of law. I pass over all the grounds insisted upon by way of laches on the part of the officers of the government, for the decisions of the supreme court have fully settled them.

The first ground insisted on by way of de-fence is, that the act of 1817, c. 197 [3 Story’s Laws, 1622; 3 Stat 350, c. 24], is a complete discharge of the first bond as to all sums received after the second bond was executed. The statute provides, “that every person now in service, or who may…
