BARKETT, Circuit Judge:
The Board of County Commissioners of Escambia County, Florida (“the County”) appeals from a summary judgment in favor of Frankenmuth Mutual Insurance Company (“Frankenmuth”). The summary judgment order declared enforceable a computer lease-purchase agreement (“the Lease”) between the County and Un-isys Leasing Corporation, Frankenmuth’s predecessor in interest. Frankenmuth cross-appeals the district court’s denial of its motion for costs and attorneys’ fees.
