It is agreed that defendant was plaintiffs’ agent in the state of Texas for the sale of certain vehicles made by plaintiffs, and the real controversy is over the nature of that agency, or rather upon the amount of salary and commission to be paid. Defendant admitted that he had made *279collections for plaintiff amounting to the sum of $4,124.13, but claimed that he had applied the same on commissions due him, and he also filed a counterclaim against the plaintiffs, in which he asked judgment for additional services rendered, amounting to $1,265.87.
