Michael Groose, Superintendent of the State of Missouri’s Jefferson City Correctional Center, appeals from the district court’s1 order granting Hillum Safat Qital Abdullah a writ of habeas corpus ordering Abdullah be released unless the State takes steps within ninety days of disposition of this appeal to provide Abdullah a new trial. Ab-dullah is currently serving a five year sentence for his conviction of unlawful use of a weapon. Mo.Rev.Stat. § 571.030.1(1) (1986).
